Opgelucht over arrest Hoge Raad

The Dutch Supreme Court has annulled the verdict of the Court of Amsterdam that said that the Dutch Association Against Quackery was wrong to call manual therapist Maria Sickesz a quack.

The Supreme Court said in its judgement that the Association made it clear enough that they intended the more neutral meaning of the word, namely without the implication of swindle or fraud. The principle of freedom of speech clearly protects the Association.

Moreover, Sickesz' claim to be able to cure schizophrenia by manipulating neck vertebrae is so poorly supported by science that she cannot reasonably ask the Association to state that her type of treatment is effective.

The Supreme Court indicated that the Court of The Hague should retry the case.

The Association is very relieved that the principle of freedom of speech has prevailed.

Boven de papieren versie hiervan heeft een koppenmaker gezet: 'Hoge Raad: "kwakzalver" is niet altijd belediging'; dit is niet erg correct want het ging niet om het misdrijf van belediging (Wetboek van Strafrecht artikel 266) maar om een mogelijke onrechtmatige daad die beoordeeld is door civiele rechters.

NRC Handelsblad citeert secretaris Frits van Dam die meldde dat de VtdK tot nu toe 90.000 euro kwijt is aan advocatenkosten voor deze ene zaak. Volgens de krant is de kostbare rectificatie indertijd niet geplaatst omdat de Vereniging anders failliet zou zijn gegaan. Dit is niet correct: ze zijn niet geplaatst omdat de tegenpartij zo verstandig was ze niet op te eisen.
